Terms of Service

These Terms of Service ("Terms") govern your use of the services provided by Maralabs ("we", "us", "our"), including website development, lead capture systems, follow-up automation, and related services. By engaging our services, you ("Client", "you") agree to these Terms.

1. Services

Maralabs provides website design, development, hosting, lead capture, and follow-up automation services for service businesses. The specific scope of work for each engagement is defined by the service tier selected (Starter, Growth, or Pro) and any additional agreements made in writing.

2. Pricing and Payment

Setup fees

A one-time setup fee is due before work begins. Setup fees are non-refundable, as they cover the time and resources invested in building your website and configuring your systems.

Monthly fees

Monthly service fees are billed on a recurring basis starting from the date your website or system goes live. Payment is due at the beginning of each billing cycle.

Late payments

If payment is not received within 7 days of the due date, we reserve the right to suspend services until the account is brought current. We will notify you before any suspension.

3. 30-Day Money-Back Guarantee

If you are not satisfied with our service within the first 30 days after your website or system goes live, you may request a full refund of your first monthly fee. To request a refund:

• Contact us at hello@maralabs.io within 30 days of going live
• Refunds apply to the monthly service fee only, not the setup fee
• Refunds are processed within 10 business days

This guarantee applies to the first month of service only.

4. Cancellation

You may cancel your monthly service at any time by providing written notice (email is sufficient). Upon cancellation:

• Your service will remain active until the end of the current billing period
• No further charges will be made after cancellation
• We will provide you with any data or assets we hold on your behalf within 14 days of your request
• Your website will be taken offline at the end of the billing period unless you arrange alternative hosting

5. Intellectual Property

Your content

You retain ownership of all content you provide to us (text, images, logos, branding). You grant us a license to use this content solely for the purpose of delivering our services.

Our work

Upon full payment for the setup phase, you own the website design and content we create for you. This includes HTML, CSS, copy, and any custom graphics created specifically for your project.

Our tools and templates

We retain ownership of our underlying templates, tools, code libraries, and processes used to deliver services. These are not transferred to you.

6. Client Responsibilities

To ensure timely delivery, you agree to:

• Provide requested information, content, and feedback within a reasonable timeframe
• Review and approve deliverables promptly
• Ensure that content you provide does not infringe on third-party rights
• Maintain the confidentiality of any login credentials we provide

7. Service Level

We aim to deliver Starter websites within 7 days and Growth systems within 10 days of receiving all required information from you. Timelines may vary depending on your responsiveness and the complexity of your requirements.

We strive for 99.9% website uptime but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance when possible.

8. Limitation of Liability

To the maximum extent permitted by law:

• Maralabs is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services
• Our total liability for any claim related to our services is limited to the amount you have paid us in the 3 months preceding the claim
• We are not responsible for lost revenue, lost leads, or business interruptions resulting from technical issues beyond our reasonable control

9. Indemnification

You agree to indemnify and hold Maralabs harmless from any claims, damages, losses, or expenses (including legal fees) arising from your use of our services, your content, or your violation of these Terms.

10. Modifications to Services and Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated date. For active clients, we will notify you of material changes via email at least 14 days before they take effect. Continued use of our services after changes take effect constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws applicable to your jurisdiction. For clients in Australia, Australian law applies. For clients in the United States, the laws of the state where the client is located apply. Any disputes will be resolved through good-faith negotiation first, and if necessary, through the courts of the applicable jurisdiction.

12. Entire Agreement

These Terms, together with our Privacy Policy and any written service agreement, constitute the entire agreement between you and Maralabs regarding our services.
